Terms of service
The agreement between you and LandlordKit. Plain language, because you should be able to read it.
What this service is
LandlordKit calculates Ontario Residential Tenancies Act dates, fills the official Landlord and Tenant Board forms with the information you provide, and keeps a record of what was prepared and why. By creating an account you agree to these terms.
It is not legal advice
This is the most important term here. LandlordKit provides forms and information. It does not provide legal advice, it is not a law firm or a licensed paralegal, and using it does not create a solicitor-client relationship. The Residential Tenancies Act is complex, its application depends on facts we do not have, and it changes. Confirm anything that matters with the Landlord and Tenant Board, a licensed paralegal, or a lawyer before you rely on it.
You are responsible for what you serve on a tenant. That includes checking that the dates, amounts, and details on a notice are correct before you sign it, serving it by a method the Act permits, and meeting any deadline that follows.
Your account
- You must give accurate account information and keep your password to yourself.
- You are responsible for what happens under your account, including what people you invite do with the access you give them.
- Turning on two-factor authentication is strongly recommended, because your account holds other people's personal information.
- You must be at least 18 years old.
Your data stays yours
You keep all rights to the information you enter. We claim no ownership of it and use it only to run the service for you, as described in the privacy policy. You can export the whole of it, as a machine-readable file, at any time and without asking us.
You are responsible for having the right to enter the tenant information you enter, and for handling it in line with your own obligations under Canadian privacy law.
Acceptable use
You agree not to:
- Use the service to harass anyone, or to prepare a notice you know is baseless.
- Attempt to access another organization's data, probe the service for vulnerabilities without permission, or interfere with its operation.
- Resell or white label the service without a written agreement with us.
- Use it for anything unlawful.
Availability
We aim to keep the service running and correct, but we do not promise it will be uninterrupted or error free. We may change or discontinue features. If we discontinue the service altogether, we will give you reasonable notice and a window to export your data.
Warranties and liability
The service is provided as is, without warranties of any kind beyond those that cannot be excluded by law. In particular, we do not warrant that a calculated date, a filled form, or any other output is legally correct or sufficient for your circumstances.
To the extent the law allows, our total liability arising out of the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential losses, including lost rent, an invalidated notice, an adjourned or dismissed application, or a penalty imposed under the Residential Tenancies Act. Nothing here limits liability that cannot be limited by law.
Ending the agreement
You can delete your organization and your account at any time from the settings page. Deletion is permanent and immediate, with no recovery window, so export your data first if you want a copy. We may suspend or end an account that breaches these terms, and we will tell you why unless we are legally prevented from doing so.
Changes to these terms
If we change these terms in a way that materially affects you, we will tell you by email before the change takes effect. Continuing to use the service after that means you accept the new terms.
Governing law
These terms are governed by the laws of Ontario, Canada, and the courts of Ontario, Canada have jurisdiction over any dispute.
